Terms of Use

1. Acceptance of terms

By creating an account on PartiPix or by using the PartiPix platform in any capacity (as a registered customer or as a guest uploading photos), you agree to be bound by these Terms of Use. If you do not agree, you must not use the platform.

PartiPix is operated by Devminds (BE 0688.824.615), Grote Veldstraat 140B, 8840 Staden, Belgium.

2. Description of the service

PartiPix is a live event photo sharing platform. Registered customers (event organisers) create events and generate QR codes. Event guests scan the QR code and upload photos from their personal devices. Those photos appear on a projected slideshow in real time.

3. Account registration

To create and manage events, you must register for a customer account. You agree to:

  • Provide accurate and complete registration information.
  • Keep your password secure and not share it with third parties.
  • Notify us immediately of any unauthorised use of your account at olivier@devminds.be.
  • Accept the Data Processing Agreement (DPA) which governs how we process guest photos on your behalf.

4. Intellectual property rights in guest photos

Ownership: Each guest retains full copyright in the photos they upload. By uploading a photo, the guest grants the event organiser (customer) a non-exclusive, royalty-free licence to display that photo on the PartiPix slideshow during the event and to store it for the duration of the applicable retention period (see our Privacy Policy).

Platform licence: By uploading a photo via PartiPix, the guest grants Devminds a limited, non-exclusive, royalty-free licence to process, store, resize, convert, and display the photo solely for the purpose of operating the PartiPix service for the event in question. This licence terminates when the photo is deleted in accordance with the retention policy.

Customer obligations: As event organiser, you are responsible for ensuring that photo uploads at your event are lawful — in particular that guests consent to their photos being projected in public. You must not use the platform for events where photo display would infringe third-party rights.

Devminds IP: The PartiPix platform software, branding, trademarks, and all related intellectual property remain the exclusive property of Devminds. You receive a limited, non-transferable licence to use the platform during a valid subscription period.

5. Acceptable use

You must not use PartiPix to:

  • Upload or display content that is illegal, hateful, sexually explicit, violent, or harassing.
  • Upload photos depicting minors without the explicit consent of a parent or legal guardian.
  • Attempt to circumvent content moderation systems.
  • Attempt to access other customers' data or events without authorisation.
  • Engage in activities that could disrupt, overload, or damage the platform infrastructure.
  • Scrape, reverse-engineer, or create derivative services from the PartiPix platform.
  • Use the platform for any unlawful purpose under Belgian or EU law.

Devminds reserves the right to suspend or terminate accounts that violate these acceptable use rules, without prior notice if the violation is severe.

6. Content moderation

Event organisers may configure AI-assisted content moderation per event. Devminds does not accept liability for content that passes moderation and is displayed on the slideshow. As event organiser, you are responsible for monitoring your event's slideshow and taking action on any content that you deem inappropriate.

7. Payment and packages

PartiPix is offered in paid packages (Small, Medium, Large). Payment is processed via Stripe. Package prices are displayed on the pricing page and are subject to applicable Belgian VAT. Payments are non-refundable except as required by Belgian consumer law.

8. Availability and service levels

We aim to provide a reliable service but do not guarantee 100% uptime. Devminds is not liable for service interruptions caused by maintenance, third-party infrastructure outages, or force majeure events.

9. Limitation of liability

To the maximum extent permitted by Belgian and EU law, Devminds is not liable for indirect, incidental, or consequential damages arising from your use of PartiPix. Our total liability for any claim arising from these Terms shall not exceed the amount you paid to Devminds in the 12 months prior to the claim.

10. Governing law and jurisdiction

These Terms are governed by Belgian law. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Bruges (West-Flanders), Belgium, unless mandatory EU consumer law provides otherwise.

11. Changes to these terms

We may update these Terms of Use. Registered customers will be notified by email of material changes. Continued use of the platform after the effective date of the updated Terms constitutes acceptance.
